Paying the full price for Bitcoin may still leave a retail purchase under futures-style oversight, according to a preliminary interpretation in the Commodity Futures Trading Commission’s open crypto consultation. Declining financing does not, by itself, remove a qualifying trade from that framework when a covered offer applies and neither actual delivery nor another statutory exception removes it from coverage. The CFTC announced the consultation on Oct. 5, and the advance notice of proposed rulemaking was published in the Federal Register on Oct. 13. Comments are due Dec. 14. It sets out the agency’s preliminary reading of existing law and seeks input for possible rulemaking; it does not enact a new final trading rule.
